Lima, December 8 (RHC)-- The Peruvian Prosecutor's Office began a preliminary investigation on Thursday against the designated president Dina Boluarte for alleged omission in the fulfillment of her duties.

According to a statement from the Public Ministry, the investigation is carried out through the area of ​​illicit enrichment and constitutional complaints.  The note indicates that the president did not inform the Council of Ministers and Congress, as indicated by the Constitution, of her temporary inability to exercise her functions from June 29 to July 9, 2023 due to that surgical procedure.

The opening of the investigation occurred after the statements of former Prime Minister Alberto Otárola, who informed the Congressional Oversight Commission that Boluarte was absent for ten days as a result of the operation. This would imply that during that time he did not fulfill his duties, although Otárola insisted that he remained aware of the country's affairs.

Criminal lawyer Luis Lamas Puccio said in an interview with a local media outlet that there are minimal reasons to consider possible criminal liability. In his opinion, the President-designate could have incurred a constitutional violation by interrupting her presidential term.

Lamas emphasized that there are sufficient elements to propose the presidential vacancy, suggesting that public opinion had been deceived.

He also highlighted “what really marks the course of the analysis of the events are two facts. The first is that it was a frivolous intervention without any justification and the other is that the information was hidden to misinform and try by all possible means to ensure that the absence of the president was not known or had the necessary relevance.”

On the other hand, lawyer Andy Carrión clarified that the preliminary investigation will not focus on whether the intervention was of an aesthetic nature, but on the reason why Boluarte did not communicate the procedure to the Council of Ministers and Congress.

Carrión also stressed the need to determine who assumed the Presidency during the period in which the president was incapacitated.  According to constitutional lawyer Heber Joel, the Constitution prohibits the creation of power vacuums, but what happened would not necessarily justify a presidential vacancy.
