Brazil's Attorney General files suit against far-right former president Jair Bolsonaro for attempted coup

Brasilia, February 19 (RHC)-- In news from Brazil, the Attorney General's Office (PGR) on Tuesday charged former Brazilian President Jair Bolsonaro (2019-2022) for his participation in the attempted coup after the 2022 elections, when he was defeated at the polls by the country's current president, Luiz Inácio Lula da Silva.

The entity formally denounced the former president, accusing him of three crimes: attempted coup d'état, violent abolition of the Democratic Rule of Law and leading an armed criminal organization.   The accusation represents the first element to initiate the legal process, and was formalized before the Federal Supreme Court (TSF), which will process to decide whether to accept it and charge the representative of the Brazilian far right.

The document signed by Attorney General Paulo Gonet, consists of more than 200 pages alleging Bolsonaro's responsibility as the leader of the coup strategy, which ended with the assault, by his supporters, on the buildings of the three branches of the State in Brasilia, on January 8, 2023.

"The organization had as leaders the President of the Republic himself and his candidate for vice president (in the 2022 elections), General Walter Braga Netto."   

The Attorney General provided the Supreme Federal Court (STF) with a complaint against 34 people accused of encouraging and carrying out acts against the Three Powers and against the Democratic Rule of Law. The facts were divided into five accusations.

The defendants are responsible for carrying out the following crimes: armed criminal organization; attempted violent abolition of the Democratic Rule of Law; coup d'état; damage qualified with violence and serious threat, against the assets of the Union, and with considerable harm to the victim; deterioration of property.

The charges are based on manuscripts, digital files, spreadsheets and exchanges of messages that reveal the scheme of breaking the democratic order. They also detail the conspiratorial plot articulated and executed against democratic institutions.

The organizers were the former president and his vice-presidential candidate, together with other people, including civilians and military personnel, who tried in a coordinated manner to prevent the implementation of the results of the 2022 presidential elections.

If the TSF rejects the complaint, the investigation will be archived, however, if it is approved by the 11 ministers of the court or by the First Chamber of the Court, the former president will become indicted and criminal proceedings will begin against him.
