The new body of Law voted in the eighth ordinary session of the ninth legislature of the ANPP respects and maintains the Cuban tradition in the military judicial field, said Ruben Remigio Ferro, president of the People's Supreme Court.
This Law is consistent with modern criminal procedural Law, responds to the Constitution approved in 2019, and replaces the previous legislation on the subject, in force since 1977.
Likewise, Ferro said, it guarantees a fair procedure in which the defendant has within his reach all the possibilities for the defense of his case while reinforcing the guarantees to the victims.
In its 744 articles, it includes guarantees of prior communication of the accusation, the right of the accused to a defense counsel of his own or at the expense of the State, the possibility of presenting witnesses or other means of proof, guarantees the right against self-incrimination, and establishes appeals against the decisions adopted.
It thus incorporates and consolidates fundamental principles such as the disposition of the ordinary justice system, to which the addition of the Habeas Corpus remedy is related.
Among other aspects, it provides the investigative bodies and the Prosecutor's Office with the procedures and guarantees to develop an independent, functional, and agile activity, with the purpose of developing a multilateral, objective, and consistent investigation.
