Brazilian court quashes case against Flavio Bolsonaro

Flavio Bolsonaro gets off easy.

Brasilia, November 11 (RHC)-- Brazil's Supreme Court of Justice (STJ) annulled all the decisions of the Rio de Janeiro Justice in the case against Senator Flavio Bolsonaro -- the son of the current president -- who is accused of diverting public funds.

The Fifth Chamber of the judicial body by annulling the case rendered useless the evidence collected and the records and seizures presented against the son of President Jair Bolsonaro, who was pointed out by the Prosecutor's Office of Rio de Janeiro as responsible for corrupt acts during his tenure as a deputy of the state Legislative Assembly of Rio de Janeiro (Alerj).

By 4 votes to 1, the members of the STJ followed the argument of Flavio Bolsonaro's defense and decided that he is entitled to the privileged forum of state deputy, and for this reason his case could not be in the hands of a judge of first instance.

Flavio Bolsonaro and his former advisor Fabricio Queiroz are suspected of the organization of illegal salary transfer, known in Brazil as rachadinha, in his tenure as a deputy of the Alerj.

This case encloses charges of embezzlement, money laundering and criminal organization. At the end of 2018 the information came to light, after the financial movement control agency discovered movements of funds between 2016 and 2017 in a bank account of Flavio Bolsonaro.

The so-called "rachadinha" points out that parliamentarians confiscate part of the salary received by their advisors, whom they appoint without a democratic process.  In the case of the investigation of Flavio Bolsonaro, the process is back to square one and will have to be investigated in another judicial area.
